Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and OpenTeam LLC ("we," "our," or "us") governing your access to and use of the Crafty's Bar website and services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

Use of the Service

Eligibility

You must be at least 21 years of age to use this Service. By using the Service, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms.

Permitted Use

You may use our Service to:

• Browse and search for drink recipes
• Interact with our AI bartender chat feature
• Create custom drink cards
• Create and share gift cards
• Submit user-generated recipes
• Share content via provided links

Prohibited Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Submit content that is defamatory, obscene, pornographic, abusive, or offensive
• Submit content that infringes on the intellectual property rights of others
• Submit content that contains hate speech, harassment, or discrimination
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

User-Generated Content

Content Ownership and License

IMPORTANT: By submitting any recipe, image, or other content to our Service (including but not limited to custom recipes, recipe images, custom drink card content, and any other user-generated content), you hereby grant to OpenTeam LLC a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media format and through any media channels, whether now known or hereafter developed.

Ownership Transfer: You acknowledge and agree that any recipe, image, or other content you submit to our Service becomes the property of OpenTeam LLC for universal, unrestricted use. OpenTeam LLC may use, modify, distribute, and commercialize such content without any obligation to you, including but not limited to using it in marketing materials, product features, or any other purpose OpenTeam LLC deems appropriate.

You represent and warrant that you own or have the necessary rights, licenses, and permissions to grant the rights described above, and that your content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.

Content Moderation

We reserve the right to review, edit, remove, or refuse to publish any content submitted to our Service at our sole discretion, without prior notice. We may remove content that violates these Terms, is reported by users, or is otherwise objectionable. We are not obligated to monitor user-generated content but may do so at our discretion.

Intellectual Property

The Service and its original content, features, and functionality are owned by OpenTeam LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks, service marks, and logos may not be used without our prior written consent.

No Medical or Legal Advice: The Service provides information about alcoholic beverages and recipes for entertainment purposes only. We do not provide medical, legal, or professional advice. Please drink responsibly and in accordance with applicable laws.

Service Availability: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

Content Accuracy: While we strive to provide accurate information, we do not warrant the accuracy, completeness, or usefulness of any information on the Service. Recipe ingredients, instructions, and nutritional information are provided for informational purposes only.

Limitation of Liability

To the maximum extent permitted by law, OpenTeam LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Indemnification

You agree to defend, indemnify, and hold harmless OpenTeam LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
